website (collectively, the “Site”), you are becoming a user (“User”, collectively, “Users”). These Terms and
Conditions also state that by signing up, you are certifying you have read and understand our Terms and Conditions
as well as our Privacy Policy. Furthermore, you are agreeing to the contents and conditions listed in each.
Yourfreeitunes reserves the right to change its Terms and Conditions at any time, for any reason, without notice.
Please check these Terms and Conditions frequently for changes. Your use of the Site following any such
modification constitutes your agreement to follow and be bound by the Terms and Conditions as modified. If you
breach any of these Terms and Conditions, your right to use this Site will be terminated.
Yourfreeitunes operates two kinds of sites: referral based sites and points based sites. We reserve the right,
at our sole discretion, to change the methods through which free items are earned. This may include, but is not
limited to, increasing the number of people you have to refer or increasing the number of points you must earn.
We may also add or remove any product listed as an incentive at any time. If we replace a product, the new product
may not be of equal value. We also reserve the right to discontinue any or all of our web sites at any time without
notice or reason. In the event that we discontinue any of our web sites, we will make every reasonable effort to
provide sufficient advance notice. Furthermore, in consideration of your use of the Site, you represent that you are
of legal age to form a binding contract and are not a person that is barred from using the Site under the laws of
the United States or other applicable jurisdiction.
These terms apply to any and all web sites owned and operated by Yourfreeitunes.
I. Membership
1. All users must provide accurate and truthful information about their identity to Yourfreeitunes, their websites,
and their advertisers.
2. Users shall not use another person’s name or information to create an account, meaning you may not sign up for
another person.
3. All addresses must be in the following countries: United States.
4. Users must be currently living in and be signing up from within the country to which their free gift will be
sent.
5. Only 1 (one) account is allowed per household. A household includes your mailing address, and may include your
IP address. All accounts with the same shipping address will be placed on hold. There is no guarantee that they
will ever be taken off of hold. Be aware that joining Yourfreeitunes from a shared internet connection such as
those available from schools, businesses, or public facilities may result in you having the same IP address as
another member and can be considered creating a duplicate account, which may result in your account being placed
on hold. You may not use AOL and/or Netzero to signup or complete offers due to the fact that they use proxy
servers.
6. One person may not have more then 1 (one) account at each different Yourfreeitunes website, even if they provide
different shipping addresses. If a person is suspected of having more than one account, all suspicious accounts
will be placed on hold. There is no guarantee that they will ever be taken off of hold.
7. Referrals and/or points cannot be transferred or donated from one account to another. Two or more accounts
cannot be merged into one account.
8. If your account is placed on hold, you are not permitted to create another account. Any user who is found to
create an account when they already have an account that is on hold will be banned from all Yourfreeitunes sites.
9. A user may not use another person's name or information to receive products from this website. For example,
one person may not join the site for another person, or complete offers for another person's account.
10. Users are responsible for the security of their own account(s). Users cannot share their account information
with others and are responsible for keeping their own passwords secure. Yourfreeitunes is not liable for any loss
due to the theft or misuse of your account or its information.
11. Any unauthorized use, entry, or hacking into any Yourfreeitunes site is illegal and is punishable by law. The
slightest violation of any law will provide sufficient impetus for us to prosecute the offender to the fullest
extent of that law.
12. Ownership of an account may not be transferred to another person.
II. Offers
1. Receiving credit for completing an offer cannot be guaranteed. You may submit a request for credit, and we
will try to give you credit for that offer, but we cannot guarantee that you will receive any form of credit. We
reserve the right to deny credit for an offer for any reason.
2. Yourfreeitunes cannot be responsible for any delays in reporting of offer completions.
3. Users must complete the offer by using the link provided by Yourfreeitunes. If you go to the web site directly,
use another affiliates link, or go to the offer site by any means other than through this web site, we reserve the
right not to give you credit for that offer.
4. Users are responsible for saving all confirmation e-mails received by affiliate companies. These e-mails might
be needed in the case that manual credit for an offer needs to be given.
5. Yourfreeitunes is not responsible for the terms and conditions of any of the offer provider web sites or offers
on our web site. We are not responsible for any ensuing charges or contracts incurred between yourself and an offer
provider. If an offer does not credit, Yourfreeitunes is not responsible for any charges made by that advertiser.
6. Users may not complete any offer more than one time. Completing any offer more than one time, even if it is on
a different site, is considered fraudnd will result in immediate disqualification of your account.
III. Products
1. Yourfreeitunes is not responsible for the availability of a product. A product may be from time to time
backordered. In this case, we do not guarantee delivery in a timely matter. Yourfreeitunes reserves the right to
replace any product with a check in the amount of the value of the product.
2. If any account is suspected of false information in order to gain referrals, that account will be placed on
hold immediately. There is no guarantee that they will ever be taken off of hold.
3. Yourfreeitunes does offer custom gifts on its web sites, meaning that a user can request any gift that can be
purchased online. Users are not allowed to request any custom gift that requires buyers to be of a certain legal
age.
4. Only one account per shipping address is allowed. If more than one account exists for the same shipping address,
all of those accounts will be placed on hold. There is no guarantee that any of the accounts will ever be taken off
of hold.
5. We reserve the right to change or remove any free gift offered on any of our web sites at any time. If a free
gift is replaced by a different gift, the new gift may not be of equal value to the gift being replaced.
6. Yourfreeitunes will only ship free gifts to the address provided in a users account.
IV. Orders
1. Yourfreeitunes is not responsible for lost orders due to, but not limited to, incorrect shipping addresses or
faults on behalf of the shipping companies.
2. Yourfreeitunes does not take returns or exchanges.
V. Fraud
1. Any user suspected of fraud, whether it be with the advertisers or not, will be placed on hold. The follow is a
list entailing the most common types of offer completion fraud. Please note that this is not a complete list.
(A). Cancelling an offer within a few days of signing up
(B). Cancelling an offer without trying the service offered
(C). Using fake information for completing offers
(D). Signing up for an offer more than once
(E). Signing up for an offer that you are not interested in
2. Legal action may be pursued if a user is found to have done offers fraudulently.
3. We reserve the right to screen all referrals for signs of fraud. We reserve the right, in our sole discretion,
to determine which referrals are fraudulent, and to not disclose the reasoning behind this decision in order to
protect our verification methods.
VI. Account Disqualification
1. Common reasons for account disqualification:
(A). Multiple accounts.
(B). Fraudulent referrals.
(C). Negative feedback from any of our affiliates, or offers being immediately canceled.
(D). More than one account at a users shipping address.
(E). Sending your referral link to others in an unsolicited or excessive manner (this includes but is not limited
to: email, instant messages or chat rooms) or posting your referral link in newsgroups or online forums where not
allowed.
(F). Posting information on a web site, forum, or auction relating to canceling offers, including cancellation
phone numbers, cancellation time frames, and any encouragement or direction to cancel the offers after signing up
with them.
(G). The use of any software, hardware, service or technique to hide or disguise your identity or IP address is not
allowed. This includes the use of any proxy server/service which is not part of your internet service provider.
Furthermore, using an internet service provider whose purpose is to provide anonymous internet access is not
allowed.
(H). If you join with a computer that others may join from, such as a shared, public, school or work computer, it
is very likely that your account will be disqualified due to duplicate accounts. Please understand that this is
one way we check for duplicate accounts and cannot afford to make exceptions for multiple accounts created from
the same computer or computers sharing the same internet connection/proxy server.
2. Additional Terms of account disqualification:
(A). We reserve the right to disqualify a user's account at any time should they be in violation of any of the
terms and conditions outlined in this document.
(B). We are not responsible for notifying a user that his or her account has been disqualified.
(C). If an account is disqualified for any reason, All orders will be cancelled.
(D). If a user feels that he or she has been disqualified due to a mistake or misunderstanding, he or she may
contact us via our web site. We do not guarantee any user will be able to get their hold/disqualified status
reversed.
(E). We reserve the right to follow up legally on fraudulent activities.
(F). If a user has accounts on more than one Yourfreeitunes web site and any of the user's accounts are
disqualified due to fraudulent actions, all of the users accounts on all other Yourfreeitunes web sites will also
be disqualified.
(G). We are not obligated to fully disclose the reasons for a disqualification if doing so may compromise our
fraud detection methods.
(H). This agreement may be terminated, for any reason, with or without cause, at any time.
VII. Other Information
1. Yourfreeitunes is allowed to place any account on hold for any reason at any time without notice.
2. Yourfreeitunes is allowed to deny credit for any offer for any reason at any time without notice.
3. Yourfreeitunes is allowed to cancel a users order for any reason at any time without notice.

XII. General Provisions.
(A) Every provision of these Terms and Conditions will be construed, to the extent possible, so as to be valid
and enforceable. If any provision of these Terms and Conditions so construed is held by a court of competent
jurisdiction to be invalid, illegal or otherwise unenforceable, such provision will, to the extent so held, be
deemed severed from these Terms and Conditions, and all other provisions will remain in full force and effect.
Any and all disputes relating to these Terms and Conditions, the Site, your use thereof, or the Content
(collectively, "Disputes") are governed by, and will be interpreted in accordance with, the laws of the state of
California, without regard to any conflict of laws provisions. Any Dispute will be venued in a state or federal
court situated in the state of California, and you hereby irrevocably submit to the personal jurisdiction of such
courts for that purpose.
(B) Entire Agreement/No Waiver. These Terms and Conditions and the Privacy Policy incorporated herein by reference
constitute the entire agreement of the parties with respect to the subject matter hereof. No waiver by
Yourfreeitunes of any breach or default hereunder will be deemed to be a waiver of any preceding or subsequent
breach or default.
(C) Correction of Errors and Inaccuracies. The Content may contain typographical errors or other errors or
inaccuracies and may not be correct or current. Yourfreeitunes reserves the right to correct any errors,
inaccuracies or omissions and to change or update the Content at any time without prior notice. Yourfreeitunes
does not, however, guarantee that any errors, inaccuracies or omissions will be corrected.
